Design Talent Terms
These Terms of Service (“Terms”) govern your access and use of the website,
mobile app, and other online services (collectively, the “Services”) provided by
DESIGNTALENT LLC (“we”, “us”, or “our”). By using the Services, you agree to
be bound by these Terms and our Privacy Policy, which is incorporated by
reference. If you do not agree to these Terms, you must not use the Services.
What are the Services?
The Services are a platform that connects designers, developers, and other creative professionals (“Talents”) with clients who are looking for their skills and expertise (“Clients”).
How do the Services work?
When you choose a service from us, you agree to pay the agreed amount and follow our terms of service. We will assign your project to our professional team, who will complete it within the specified timeframe. We will then send you the completed project for your review. If you are satisfied with the project, we will finalize it and send you the final files. If you request any revisions, we will send the project back to the team and they will work on it until you are happy with the result.
What are our rights and obligations?
We reserve the right to modify, suspend, or terminate the Services, or any part thereof, at any time, for any reason, and without notice or liability to you. We may also change, update, or revise these Terms from time to time, and we will notify
you of any material changes by posting the new Terms on the Services, or by sending you an email or other notification. Your continued use of the Services after the effective date of the new Terms constitutes your acceptance of the
changes. We reserve the right to monitor, review, or remove any content or activity on the Services, at our sole discretion, and without notice or liability to you. We may also suspend, limit, or terminate your access or use of the Services, or any part thereof, if we determine that you have violated these Terms, our policies, or any applicable law, or if we believe that your use of the Services poses a risk or harm to us, our users, or our partners. We provide the Services on an “as is” and “as available” basis, and we make no representations or warranties of any kind, express or implied, regarding the Services, or any content or user thereof. We disclaim all liability for any damages, losses, or injuries that may arise from or relate to your access or use of the Services, or any content or user thereof. To the fullest extent permitted by law, our total liability to you for any claim or cause of action arising from or relating to these Terms or the Services is limited to the amount of fees that you have paid to us in the past six months.
What else should you know?
These Terms constitute the entire agreement between you and us regarding the Services, and supersede any prior or contemporaneous agreements, communications, or understandings. These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles. Any disputes arising from or relating to these Terms or the Services will be subject to the exclusive jurisdiction and venue of the state and federal courts located in Lewes, Delaware.
